| SECTION D - TRADING DEBTS |
(a) Is it usual in this economy for suppliers of goods or
services to supply those goods or services to corporations on
credit?
|
Yes. In Indonesian business practice, it is customary for suppliers
of goods and services to supply goods and services on credit.
|
(b) If so, what would be the average credit period of time?
|
This average credit period varies greatly and will depend on
the state of the economy in general, the business sector and the
types of goods or services involved.
|
(c) Is it possible and/or usual in this economy for a supplier
to require security over property of the corporation for the supply
of goods or services?
|
No. It would not be common for a seller of goods or services
to take a security interest over goods in an ordinary sale of
goods or services transaction.
|
(d) If so, is the form of supply known as 'retention of title'
practised and recognised in this economy and is it enforced?
|
If "retention of title" means hire purchase, this system
is used in Indonesia. There are no general provisions pertaining
to hire purchase in the ICC. We believe the supplier's right of
retention of title is effective and enforceable, but such right
is subject to the same difficulties of enforcement in the Indonesian
judicial system as other rights.
